Consent to Treatment
By attending an appointment at MyoActive Clinic, you acknowledge and consent to our therapists performing the necessary assessments and treatments based on their professional training, qualifications, and understanding of your condition. You understand that different therapists at MyoActive may be involved in your care throughout your treatment.
You have the opportunity to discuss the nature and purpose of your treatment with your therapist before any procedures are performed. You may choose to discontinue treatment at any time.
You acknowledge and accept the following:
1. Treatment
1.1 Physiotherapy and related treatments may include physical techniques, including manual therapy ("hands-on" treatment), among other approaches.
1.2 You have the right to choose your therapist, decline treatment, or request a second opinion at any time.
1.3 Treatment carries inherent risks, including but not limited to soreness, stiffness, soft tissue injury, neurological issues, skin irritations, burns, and other minor complications.
1.4 We take all precautions to minimize risk by conducting thorough assessments of your condition.
1.5 Alternative treatments may be available. If your condition is outside the scope of physiotherapy or if physiotherapy poses too high a risk, your therapist may refer you to another healthcare provider.
1.6 Untreated conditions may lead to complications, such as scar tissue, adhesions, and degenerative changes that can result in pain, restricted movement, and loss of function. Delays in treatment may lead to further complications.
2. Consent to Obtain and Release Information
2.1 To ensure timely and effective care, you agree that it may be necessary to share information about your condition with other healthcare providers, case managers, or legal representatives involved in your treatment.
2.2 By agreeing to these Terms and Conditions, you consent to MyoActive Clinic exchanging information related to your injury, treatment, or claim with relevant parties when necessary.

3. Exclusion of Liability
3.1 MyoActive Clinic and its employees are not liable for any injury, loss, or damage resulting from treatments or procedures, except where caused by the negligence of the clinic’s staff.
4. Privacy and Contact
4.1 MyoActive Clinic may send you appointment reminders via SMS or email.
4.2 From time to time, you may receive marketing communications or surveys to help us improve our services and offer promotions.
4.3 You have the right to opt out of SMS or email communications at any time.
4.4 We will not share your personal information with third parties, except when necessary for your treatment or injury claim, as outlined in section 2.

5. Payments and Billing
5.1 Payment for services and items provided is required on the day of your consultation.
5.2 Payments can be made via phone or in-person at the clinic. Alternative payment arrangements may be available at the clinic’s discretion.
5.3 Personal or healthcare items are non-refundable if you change your mind. If there is a major defect, we will offer a refund or exchange. Minor defects will be repaired within a reasonable timeframe.
5.4 Our billing procedures are designed to maintain the quality of care we provide and are not intended to exclude or discriminate against any person or group.
6. Late Arrivals and Missed Appointments
6.1 If you arrive late within your scheduled appointment time, treatment may still be provided for a reduced duration.
6.2 Missed appointments or arriving outside the scheduled time will incur a cancellation fee of $50.
6.3 If you reschedule the appointment on the same business day, no cancellation fee will be charged, subject to therapist availability.
6.4 You must provide at least 24 hours’ notice to cancel or reschedule an appointment.
7. Initial Booking Fee
7.1 A non-refundable $35 booking fee is required to secure your initial appointment. Our team will contact you to arrange payment via phone or bank transfer. If payment is not received within 24 hours, we reserve the right to cancel the booking.
7.2 If you need to cancel or reschedule your initial appointment, you must notify us at least 24 hours before your scheduled time.
7.3 If you cancel at least 24 hours before your appointment, the $35 booking fee may be applied to your rescheduled initial appointment.
7.4 If you miss your initial appointment or cancel within 24 hours, the $35 booking fee will be forfeited.
7.5 The $35 booking fee does not apply to initial appointments covered by WorkCover, NDIS, or other third-party insurers.
7.5.1 For the booking fee waiver to apply:
- Notify us during the booking process if another provider will cover the fees,
- Submit the appropriate referrals,
- Obtain prior approval for payment from the third-party insurer.
If these conditions are not met, the $35 booking fee will be the patient’s responsibility, and the terms in section 7.1-7.4 will apply.
8. Satisfaction Guarantee
At MyoActive Clinic, we strive to provide exceptional care. If you are not completely satisfied with your treatment, we will refund your consultation fee.
This guarantee is subject to the following terms:
8.1 Claims must be made before your next appointment or within 7 days after your consultation.
8.2 Refunds apply to a single consultation, not a series of sessions.
8.3 Refunds will be processed using the same payment method as the original consultation.
